Terms & Conditions.

In these Terms: “Client”, “you” and “your” mean the person using the Website or named as purchaser; “House”, “we”, “us” and “our” mean the legal operator identified in clause 2; “Website” means daralpashmina.com and its associated ordering experience; “Piece” means the individual item described on its product page; “Order Acknowledgement” means confirmation that an order was received; and “Order Acceptance” means the separate communication or conduct described in clause 9 that creates the sale contract.

“Business Day” means Sunday to Thursday excluding an official public holiday in Qatar. “Writing” includes email and, where appropriate, WhatsApp sent to the contact details officially published by the House. A reference to a law includes its amendments and replacement provisions; “including” is illustrative and not limiting; and the singular includes the plural where the context allows.

Headings, summaries and navigation labels assist reading but do not alter legal meaning. If an item-specific term is inconsistent with a general term, the item-specific term controls for that Piece, subject always to mandatory law.

These Terms & Conditions (the “Terms”) govern access to daralpashmina.com, any associated mobile experience, and purchases made from Dar Al Pashmina (together, the “Website” and the “House”). By using the Website, and separately by submitting an order, you agree to the Terms in force at that time.

The Website and sales are operated by Dar Al Pashmina for Clothing, a Single-Member Limited Liability Company (LLC), trading as Dar Al Pashmina, Commercial Registration number 252747, registered in the State of Qatar. Contact: social.daralpashmina@gmail.com and +974 7474 5160.

The House operates as an online boutique at launch and does not offer walk-in retail premises. A registered or correspondence address does not become an exchange-collection or visiting location unless the House expressly confirms it in writing.

If you do not agree to these Terms, do not use the Website or place an order. The Terms of Sale in Part B apply in addition whenever you buy a Piece.

You must have legal capacity to contract and, if you are under the age of majority, use the Website only with the involvement of a parent or legal guardian. The boutique is intended for genuine consumer purchases for personal use or gifting, not unauthorized commercial resale.

You must provide complete, current and accurate order, contact, payment and delivery information; keep any account credentials confidential; and tell us promptly if you suspect unauthorized use. You are responsible for activity carried out through your account unless caused by our failure to use reasonable security.

We may apply reasonable purchase limits, decline suspected reseller orders, or request verification where necessary to protect clients, the House, stock integrity or payment security.

The Website, Dar Al Pashmina name and marks, logo, layouts, copy, photography, product names, graphics and other content are owned by or licensed to the House and protected by applicable intellectual-property laws. You receive a limited, revocable, non-transferable right to use the Website for personal shopping.

You must not, without written permission: reproduce or exploit content commercially; scrape, harvest or systematically extract data; frame or mirror the Website; interfere with security or operation; introduce malicious code; use automated purchasing tools; impersonate another person; infringe rights; or use the Website unlawfully, fraudulently or abusively.

Linking to a public page in a fair and lawful way is permitted provided it does not imply endorsement or association. We may require any link to be removed.

We use reasonable care to keep the Website accurate, secure and available, but cannot promise uninterrupted, error-free or virus-free operation. We may maintain, change, suspend or withdraw any part of the Website where reasonably necessary, including for security, compliance or operational reasons.

The Website may rely on or link to independent payment, hosting, analytics, messaging, mapping or delivery services. Their own terms and privacy practices may apply. A link does not mean we control or endorse the third party, although we remain responsible for our own obligations and for anything the law makes our responsibility.

You should use current software and reasonable device security. Please report suspected security problems privately rather than exploiting or publishing them.

Dar Al Pashmina curates authentic Pieces sourced directly from Kashmir, India. The collection includes pure pashmina and pure silk Pieces; the exact fibre, origin, weave, handwork, measurements, condition notes and any supporting documentation for the individual Piece are stated on its product page and together form its description. No material, craft or certification statement made for one Piece applies automatically to another.

We distinguish documented fact from general craft context. Terms such as pashmina, cashmere, shawl, stole, ghutra, handwoven, embroidered, vintage, certified or geographical indication are used only where the particular listing supports them. Supporting documents are included or referenced only where they genuinely exist.

Handmade and natural-fibre Pieces may show small irregularities, weave variations, slubs, tonal movement or differences in hand and dimensions. Those characteristics are not defects where they are normal for the stated material or method and do not materially depart from the description. Screen, lighting and photography may affect perceived colour, so clients for whom an exact tone is critical should request additional images or video before ordering.

Prices are shown in Qatari riyals (QAR). The Piece price and complete amount payable are confirmed by the House before Order Acceptance. Standard delivery to supported addresses throughout Qatar is complimentary at launch with no minimum spend. Any exceptional service or future charge must be disclosed before you confirm the order and will never be added afterwards without agreement.

We may change prices prospectively at any time. A change does not affect an order already accepted. Despite reasonable checks, a price or description may be obviously wrong. Before accepting the order, we may correct the error and invite you to confirm at the correct price, or cancel it. If money has already been received for an order we do not accept, it will be returned through a method confirmed by the House as soon as reasonably practicable.

Promotions, codes or gifts apply only according to their stated terms, dates, stock and eligibility, cannot be exchanged for cash, and may not be combined unless expressly permitted. Any promotion will remain subject to required Qatar approvals.

To begin an order, open the Piece page and select “Order with the House”. WhatsApp opens with the Piece details ready to share. Review the Piece name or reference, then provide the requested Qatar delivery and recipient details. Sending the message is an enquiry and does not itself reserve the Piece or create a sale contract.

The House will confirm availability, the complete price, delivery arrangements and the available payment method before the order proceeds. You may correct the Piece, recipient, address or other details before expressly confirming the arrangement. Please report any later error immediately; changes may not be possible after preparation or dispatch.

The accepted order and these Terms can be saved from the relevant WhatsApp or electronic conversation. We retain order records for legal, accounting, support and fulfilment purposes in accordance with the Privacy Policy and applicable law. The accepted order documentation will include a dated invoice or equivalent record containing the supplier, Piece, quantity, price and other information required by Qatar law.

Your order is an offer to buy. A binding sale contract is formed only when we send an express Order Acceptance or Dispatch Confirmation, or otherwise begin performance in a way that clearly communicates acceptance. Payment authorization or an automated order-received message alone does not constitute acceptance.

Before acceptance, we may decline or cancel an order for legitimate reasons including unavailable stock; inability to verify payment, identity or delivery information; suspected fraud or unauthorized resale; an obvious price or listing error; legal or regulatory restriction; an unsupported delivery address; or an event outside reasonable control. We will tell you and release, reverse or refund any amount taken for an unaccepted order.

After acceptance, we will cancel only where these Terms, the final Delivery & Exchange Policy or applicable law allows, and will provide any remedy required by law.

At launch, the House accepts Fawran transfer and cash on delivery, subject to confirmation for the individual order. You confirm that you are authorised to make the selected payment and to pay the agreed total. Never send passwords, one-time codes or complete payment-card details through WhatsApp or email.

A Fawran transfer must reach the account details officially confirmed by the House and may need to clear before dispatch. Cash on delivery is payable as arranged when the Piece is delivered. The House may carry out reasonable identity, address, sanctions and fraud checks before accepting or completing an order.

If a payment is reversed, charged back or found unauthorized after acceptance, we may suspend fulfilment, seek a lawful replacement payment, recover the Piece where permitted, and pursue reasonable direct losses caused by fraud or unlawful conduct.

Pieces are acquired in limited quantities and may be unique or unavailable again. A WhatsApp enquiry, request for photographs or expression of interest does not reserve a Piece. Stock remains subject to verification until the House expressly confirms reservation or Order Acceptance.

If a Piece becomes unavailable before acceptance, we may offer an alternative only for your separate approval; we will never substitute a different Piece without consent. If we cannot supply the ordered Piece, any amount collected for it will be reversed or refunded.

Legal title passes only after full cleared payment and any required delivery, to the extent permitted by law. Nothing in this clause limits statutory rights concerning possession, risk or remedies.

At launch, we deliver only to supported addresses within the State of Qatar. Standard delivery is complimentary with no minimum spend. The supported area, estimated delivery window, service level and any genuine exclusion will be confirmed by the House before Order Acceptance. A date or window is an estimate unless expressly accepted by the House as binding.

You must provide an accurate address, working Qatar contact number, recipient name and any access details, and ensure an authorized person is available. We may contact you to coordinate delivery. We are not responsible for delay caused by incorrect details, lack of access or failure to respond, although we will act reasonably to rearrange delivery. Reasonable third-party costs caused by repeated failed delivery may be charged only if disclosed and permitted by law.

Risk of loss or damage passes when the Piece is delivered into the physical possession of you or a person you designate, unless applicable law requires otherwise. If we become aware of a material delay or difficulty, we will notify you. Statutory rights concerning late or failed delivery remain unaffected.

Please inspect the parcel and Piece as soon as reasonably possible. If the parcel appears materially damaged or tampered with, photograph it before opening where safe. Contact us promptly with the order number, a description and clear photographs if a Piece is missing, damaged in transit, defective or not the item ordered.

Prompt notice helps preserve evidence and enables a fast remedy, but a delay in notifying us does not extinguish any right that cannot lawfully be lost for that reason. Keep the Piece, packaging, labels and supplied documentation until we provide instructions; do not use, wash, alter, repair or send the Piece elsewhere if doing so could worsen the issue or compromise assessment.

Where we confirm an error, transit damage, defect or material misdescription, we will provide the remedy required by Qatar law, which may include repair where appropriate, replacement where available, price adjustment or refund.

For a discretionary change-of-mind exchange, contact the House within three calendar days after confirmed delivery. The Piece must be unused and unworn beyond reasonable inspection, unwashed and unaltered, with all tags and security devices intact, and supplied with every box, protective layer and document received. Proof of purchase and the order number are required.

Exchange eligibility must be confirmed before collection. One approved collection within Qatar is complimentary. After inspection, an eligible Piece may be exchanged for another available Piece. The House will confirm the available options and treatment of any price difference before the exchange proceeds. We do not provide a change-of-mind refund.

Contact us as soon as possible if a Piece is missing, damaged in transit, defective, unsafe, inauthentic, incorrectly supplied or materially misdescribed. Evidence provided within 48 hours of confirmed delivery is especially helpful for visible transit damage, but that request does not remove a right that cannot lawfully be lost because notice came later.

Nothing in this commercial policy excludes or restricts any remedy, cancellation, rescission, refund, compensation or other right that cannot lawfully be excluded under Qatar law. Normal disclosed natural characteristics are not defects, but a genuine defect or misdescription will not be rejected merely by calling it natural variation.

Different fibres, weaves, dyes, embellishments and ages require different care. Follow the instructions supplied for the individual Piece and the Care Guide. Where the two differ, the item-specific instruction controls. When uncertain, stop before cleaning and ask the House.

Unless expressly stated safe, do not machine wash, tumble dry, bleach, iron directly over embroidery, use household stain removers, apply perfume or cosmetics directly, or entrust the Piece to an unqualified cleaner. Store clean, dry, protected from pests, moisture, friction and prolonged strong light.

We are not responsible for loss caused after delivery by ordinary wear, snagging, staining, moths, damp, heat, chemicals, improper storage, unsuitable cleaning, alteration or failure to follow reasonable care instructions, except where the law provides otherwise.

If we reasonably believe that a Piece may be unsafe, materially mislabelled, inauthentic, subject to an official notice, or otherwise require urgent corrective action, we may suspend its sale, contact affected clients, issue instructions and arrange a recall or assessment. Affected clients should stop using the Piece where instructed, retain it safely and cooperate with a complimentary collection or other reasonable process.

Following assessment, we will provide the correction or remedy required by Qatar law, which may include replacement where genuinely available or a refund. We will not require a client to bear reasonable collection costs for a House-initiated safety or authenticity recall, and this clause does not reduce any mandatory right.

Recall, safety and material-authenticity messages are essential service communications and may be sent even where marketing has been declined. Please keep order contact details current and tell us if the Piece has been gifted or transferred so urgent information can reach the person holding it.

At launch, every selected Piece is presented in the House’s single signature box unless the listing or accepted order expressly states otherwise. The presentation is included; there are no packaging tiers, paid upgrades or personalised boxes. Design details may evolve and images are illustrative, but any substitute will provide materially equivalent presentation and reasonable protection.

If an order is a gift, you are responsible for the recipient’s accurate name, supported Qatar address and contact number and for having authority to provide their personal data. Tell the recipient to expect contact where required for delivery. A personal message or other customisation is available only if the House expressly confirms it for the order; it should not be assumed from the gifting presentation alone.

A gift recipient may request an exchange within the same three-calendar-day period, subject to the same condition requirements and available stock. The House will confirm any price difference before proceeding. No change-of-mind refund is provided, while every remedy made mandatory by applicable law remains unaffected.

We process personal data for stated and lawful purposes including responding to enquiries, taking and fulfilling orders, delivery coordination, payment and fraud prevention, record-keeping, legal compliance and service improvement. Full details—including data categories, legal basis or consent, recipients, security, retention and available rights—must appear in the final Privacy Policy.

We may send transactional email, SMS or WhatsApp messages reasonably necessary for an enquiry, order, payment, security check, delivery, recall or legal notice. Promotional messages require the consent or other basis required by Qatar law and must offer an effective way to stop them. Withdrawing marketing does not stop necessary service messages.

We use reasonable administrative, technical and organizational safeguards, but no electronic system is risk-free. Do not send complete payment-card details, passwords or unnecessary sensitive information through WhatsApp or email. A separate cookie notice and consent mechanism must be added if non-essential cookies or similar technologies are used.

Nothing in these Terms excludes or limits liability for fraud or fraudulent misrepresentation, wilful misconduct, death or personal injury caused by negligence, breach of mandatory consumer rights, or any liability that cannot lawfully be excluded or limited.

Subject to that protection, we are responsible for loss that is a direct and reasonably foreseeable result of our breach. We are not responsible for loss caused by your breach, inaccurate information, misuse, failure to follow care instructions, or an independent event outside our reasonable control. Because sales are to consumers, we are not liable for business losses such as lost profit, revenue, opportunity, goodwill or data arising from a personal purchase.

To the maximum extent permitted by law, our aggregate liability arising from a particular order will not exceed the amount paid for the affected Piece, except where a higher remedy is mandatory. Website-only claims not connected with a purchase are limited to reasonably foreseeable direct loss. These limitations are intended to allocate risk fairly and will be reduced only to the extent necessary to remain enforceable.

We are not responsible for delay or failure caused by events outside reasonable control, such as severe weather, flood, fire, epidemic, transport interruption, import or government restriction, utility or communications failure, cyberattack despite reasonable safeguards, civil disturbance, labour disruption or supplier failure not reasonably avoidable. We will take reasonable steps to reduce the effect, notify materially affected clients and resume performance when practicable. Mandatory rights relating to delay, cancellation or refund remain unaffected.

We may restrict or suspend access, cancel an unaccepted order, preserve evidence and report conduct where we reasonably believe there is fraud, unauthorized payment, attempted security compromise, abuse, harassment, infringement or other unlawful use. Measures will be proportionate and will not remove a lawful consumer remedy.

To the extent permitted by law, a user is responsible for reasonable direct loss caused to the House by that user’s deliberate unlawful misuse, fraud or infringement. This is not a broad indemnity for ordinary consumer use or for loss caused by us.

We may update Website-use terms prospectively for legal, security, operational or service reasons by posting the new version and effective date. The Terms accepted when an order is placed will govern that order unless a change is required by law or you expressly agree otherwise. We will not retroactively remove an accrued right.

We may transfer our rights and obligations as part of a lawful reorganization, business transfer or service arrangement only if this does not reduce your mandatory rights. You may transfer a contractual right only where law permits or we agree in writing; this does not restrict lawful gifting.

If a provision is unlawful or unenforceable, it will be read down or severed only as necessary and the remainder continues. A delay in enforcing a right is not a waiver. These Terms, the accepted order, the applicable Piece listing, and the final policies expressly incorporated into the order form the agreement; if they conflict, the accepted order summary and item-specific description prevail for product and price, while mandatory law prevails throughout.

No person other than the parties has a right to enforce these Terms except a lawful successor or a recipient who receives a right directly under mandatory law.

These Terms and any non-contractual obligation arising from them are governed by the laws of the State of Qatar. The competent courts of Qatar have jurisdiction, subject to any mandatory consumer right to use another forum or official complaint process.

We will acknowledge and handle the matter fairly and without affecting your right to approach Qatar’s Ministry of Commerce and Industry, Consumer Protection and Anti-Commercial Fraud Department, or another competent authority.

English and Arabic versions are provided for accessibility. If an inconsistency arises, these Terms will be interpreted in accordance with the mandatory laws of the State of Qatar, without limiting any consumer right that cannot lawfully be excluded.
